PingPilot provides digital communication and marketing solutions, including but not limited to:
- WhatsApp Business Messaging
- RCS Messaging
- Bulk SMS Services
- Marketing Automation
- Google Ads Management
- Meta Ads Management
- Lead Generation Solutions
- Customer Engagement Tools
We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
3. User Responsibilities
Users agree to:
- Provide accurate and complete information.
- Use the services only for lawful business purposes.
- Comply with all applicable laws, regulations, and industry guidelines.
- Obtain proper customer consent before sending marketing communications.
- Not use the platform for spam, fraudulent, misleading, abusive, or illegal activities.
4. Customer Data and Privacy
Users are responsible for ensuring that all customer data uploaded to PingPilot has been collected with proper consent and in accordance with applicable privacy laws.
PingPilot will take reasonable measures to protect customer information but cannot guarantee absolute security of data transmission or storage.
5. Messaging Compliance
Customers using WhatsApp, RCS, SMS, or other messaging services must:
- Obtain valid user consent before sending promotional messages.
- Comply with applicable telecom and messaging regulations.
- Respect opt-out requests promptly.
- Avoid sending prohibited, deceptive, or unauthorized content.
Any penalties resulting from non-compliance are the sole responsibility of the customer.
6. Payments and Billing
- All fees are payable in advance unless otherwise agreed.
- Messaging credits, advertising budgets, and service fees are non-refundable once utilized.
- PingPilot reserves the right to suspend services for overdue payments.
- Prices may change with prior notice.
7. Intellectual Property
All platform features, software, branding, content, databases, and proprietary technology remain the exclusive property of PingPilot.
Users may not copy, distribute, modify, reverse engineer, or resell any part of the platform without written permission.
8. Limitation of Liability
PingPilot shall not be liable for:
- Loss of profits, revenue, or business opportunities.
- Delivery delays caused by third-party service providers.
- Platform interruptions beyond our reasonable control.
- Actions taken by telecom operators, Meta, Google, or other third-party providers.
Our total liability shall not exceed the amount paid by the customer for services during the preceding three months.
9. Account Suspension and Termination
PingPilot reserves the right to suspend or terminate any account that:
- Violates these Terms and Conditions.
- Engages in unlawful or abusive activities.
- Uses the platform in a manner that may harm our reputation or infrastructure.
10. Third-Party Services
Some services rely on third-party platforms including Meta, Google, telecom operators, and messaging providers. Users must also comply with the applicable terms and policies of such providers.
11. Changes to Terms
PingPilot may update these Terms and Conditions at any time. Continued use of the services after changes are posted constitutes acceptance of the revised terms.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kerala, India.
