PINGPILOT – TERMS & CONDITIONS
These Terms & Conditions govern your access to and use of the PingPilot website, platform and communication services provided by PingPilot (“PingPilot”, “we”, “us” or “our”). By registering an account, purchasing credits, submitting an onboarding application, creating a campaign or using any PingPilot service, you agree to these Terms & Conditions. If you do not agree with these Terms, please do not use the PingPilot platform.
1. ELIGIBILITY
You must provide accurate and complete information while registering and using PingPilot. If you register on behalf of a company or organisation, you confirm that you are authorised to represent that organisation.
2. ACCOUNT REGISTRATION
Customers may be required to provide business and contact information for account creation and verification. PingPilot may request business registration documents, PAN, website details or other information where required for activation of a communication channel or for compliance purposes. Customers are responsible for ensuring that all information submitted is accurate and up to date.
3. COMMUNICATION SERVICES
PingPilot may provide communication services including SMS, RCS Business Messaging, WhatsApp Business Messaging and Voice Calling. Additional services may be introduced by PingPilot in the future. Availability of any communication channel is subject to technical availability, provider requirements, regulatory requirements and applicable approvals.
4. CHANNEL ACTIVATION
Certain communication channels require business verification or approval before they can be activated. PingPilot may require documents or information such as company registration documents, PAN, business website or other details depending on the communication channel. Submission of documents does not guarantee approval. Activation timelines displayed by PingPilot are indicative and may vary depending on the relevant service provider or regulatory authority.
5. CUSTOMER RESPONSIBILITY
The customer is responsible for all messages, campaigns and communications sent through PingPilot. Customers must ensure that they have the necessary rights, permissions and consent to contact their recipients. Customers must comply with all applicable laws, regulations, telecom requirements, privacy requirements and communication provider policies.
6. PROHIBITED USE
PingPilot must not be used for unlawful activities, fraud, phishing, misleading communications, spam, harassment, malicious content or any activity prohibited by applicable law or by the relevant communication provider. PingPilot reserves the right to restrict, suspend or terminate campaigns or accounts where misuse is identified.
7. CAMPAIGN DELIVERY
Message delivery depends on several factors including recipient network availability, device compatibility, telecom operator restrictions, communication provider policies and technical conditions. PingPilot does not guarantee 100% delivery, read rates, click rates, engagement or conversion from any campaign.
8. TEMPLATES
Certain communication channels may require message templates to be submitted for approval. Approval is subject to the relevant communication provider or regulatory authority. PingPilot does not guarantee approval of any particular template.
9. WALLET AND CREDITS
PingPilot may provide a prepaid wallet or credit system for purchasing and using communication services. Credits may be used for eligible services according to the applicable pricing and usage rates displayed by PingPilot. Customers are responsible for maintaining sufficient wallet balance for their campaigns.
10. PRICING
PingPilot may charge customers based on the communication channel, message type, volume, service provider charges and applicable pricing plans. PingPilot may change its pricing from time to time. Applicable taxes, including GST where applicable, may be charged in addition to the displayed price.
11. PAYMENTS
Customers are responsible for making payments for services purchased from PingPilot. PingPilot may restrict campaign activity or other services where required payments have not been received.
12. REFUNDS
Refunds of wallet balances or purchased credits will be subject to PingPilot’s applicable refund policy and the circumstances of the transaction. Promotional or free credits may not be refundable. Where a refund is requested, PingPilot may review the transaction before making a decision.
13. FREE TRIALS AND PROMOTIONAL CREDITS
PingPilot may provide free trials, promotional credits or other promotional offers. Such offers may have specific eligibility, usage and expiry conditions. Promotional credits are generally non-transferable and cannot be exchanged for cash.
14. CUSTOMER DATA
Customers are responsible for ensuring that they have the lawful right to upload and use any customer information or contact data submitted to PingPilot. Customers must ensure that their use of such information complies with applicable privacy and data protection requirements.
15. PINGPILOT AUDIENCE DATA
Where PingPilot provides access to its audience data, such data may be subject to specific usage conditions and restrictions. PingPilot audience data may only be used for the purposes permitted by PingPilot. Customers must not copy, scrape, extract, resell or otherwise misuse PingPilot audience data.
16. PRIVACY
PingPilot may collect and process information required to provide its services. The collection and use of personal information is governed by the PingPilot Privacy Policy. Customers are responsible for complying with applicable privacy requirements when using customer information through the platform.
17. THIRD-PARTY SERVICE PROVIDERS
PingPilot may depend on third-party telecom, messaging, technology and service providers to provide certain communication services. Service availability, pricing, approval and delivery may therefore be affected by such providers. PingPilot is not responsible for service interruptions or restrictions caused by circumstances outside its reasonable control.
18. SERVICE AVAILABILITY
PingPilot will make reasonable efforts to maintain the availability of its platform and services. Services may occasionally be unavailable due to maintenance, technical problems, network failures, provider outages, regulatory actions or other circumstances beyond PingPilot’s reasonable control.
19. ACCOUNT SUSPENSION
PingPilot may suspend or restrict an account or campaign if the customer violates these Terms, applicable law, provider requirements, payment obligations or acceptable-use requirements, or if fraudulent, abusive or suspicious activity is identified.
20. ACCOUNT TERMINATION
PingPilot may terminate an account where the customer seriously or repeatedly violates these Terms, engages in unlawful activity, misuses the services, creates security or compliance risks, or where continued service is not permitted by the relevant provider or applicable law.
21. INTELLECTUAL PROPERTY
The PingPilot name, brand, website, platform, designs, software, content and other proprietary materials remain the property of PingPilot or its respective licensors. Customers may not copy, reproduce, modify or commercially exploit PingPilot’s proprietary materials without prior written permission.
22. DISCLAIMER
PingPilot does not guarantee specific business results, sales, leads, conversions, delivery rates, engagement rates, read rates or campaign performance. Communication services are dependent on third-party networks, providers, recipient devices and other factors outside PingPilot’s control.
23. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, PingPilot will not be responsible for indirect, incidental, special or consequential losses arising from the use of its services, including losses resulting from campaign performance, communication failures, third-party provider failures or circumstances outside PingPilot’s reasonable control.
Nothing in these Terms excludes any liability that cannot legally be excluded under applicable law.
24. CUSTOMER INDEMNIFICATION
Customers agree to indemnify and hold PingPilot harmless from claims, losses, damages, penalties or expenses arising from the customer’s unlawful use of the platform, violation of these Terms, campaign content, misuse of customer information or violation of applicable laws or third-party rights.
25. CHANGES TO SERVICES
PingPilot may add, modify, suspend or discontinue services or features from time to time. Such changes may be required due to technical, commercial, regulatory or third-party provider requirements.
26. CHANGES TO THESE TERMS
PingPilot may update these Terms & Conditions from time to time. The updated Terms will be published on the website or platform. Continued use of PingPilot after the updated Terms become effective constitutes acceptance of the updated Terms, subject to applicable law.
27. GOVERNING LAW
These Terms & Conditions shall be governed by the laws of India, subject to applicable law.

28. FORCE MAJEURE
PingPilot shall not be responsible for failure or delay caused by circumstances beyond its reasonable control, including natural disasters, government actions, regulatory restrictions, telecom failures, internet failures, technical failures, third-party service outages, strikes or other similar events.
29. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to remain effective to the extent permitted by applicable law.
